Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Monster Face (the “Service”). By creating an account or using the Service, you agree to these Terms.

1) Who we are

The Service is operated by Jay Dean Haase(“we,” “us,” “our”). Contact: jayhaase@gmail.com.

2) The Service is free

Monster Face is currently provided for free. We do not charge fees, and there are no refunds. If we introduce paid features in the future, we will update these Terms and clearly describe pricing and refund terms at that time.

3) Eligibility (no one under 13)

You must be at least 13 years old to use Monster Face. If we learn that you are under 13, we may suspend your account and delete associated data.

If you are 13–17 (or a minor where you live), you represent that you have permission from a parent or legal guardian to use the Service and that they are responsible for your use.

4) Accounts and security

• You must provide accurate account information and keep it up to date.
• You are responsible for activity under your account and keeping your login secure.
• Notify us at jayhaase@gmail.com if you suspect unauthorized access.

5) User content

“User Content” includes content you submit, upload, or store through the Service (including images/files and campaign/session content).

• You own your User Content as between you and us.
• License to operate the Service: you grant us a worldwide, non-exclusive, royalty-free license to host, store, back up, reproduce, and display your User Content only as needed to provide, secure, and improve the Service, including making it available to you and the people you authorize (for example, your campaign members).
• Service providers: you also grant us the right to share User Content with our vendors (for example, hosting and storage providers) solely to operate the Service.
• Your responsibility: you represent you have the rights to provide your User Content and that it does not violate law or others’ rights.

6) Images are stored publicly

Any image you upload to Monster Face is stored in a public storage location and can be accessed by anyone who has the URL. Do not upload images you want to keep private.

7) Acceptable use

You agree not to (and not to help others to):

• Break the law or promote illegal activity.
• Infringe intellectual property, privacy, or other rights.
• Upload malware, attempt to bypass security, or disrupt the Service.
• Harass, threaten, abuse others, or promote hate or violence.
• Upload illegal sexual content, including any child sexual abuse material (CSAM). We may report suspected CSAM to appropriate authorities.

8) Suspension

We may suspend or restrict access to the Service if we reasonably believe you violated these Terms, your use creates security or legal risk, we must do so to comply with law, or your activity could harm the Service or other users.

9) Data retention after suspension/termination

If your access is suspended or your account is terminated, we may retain your User Content for up to 60 days (including backups) for operational, security, and compliance reasons and then delete it where feasible. Some information may persist in backups/logs for a limited time.

10) Copyright complaints

If you believe content on the Service infringes your copyright, email jayhaase@gmail.com with enough detail to identify the copyrighted work and the allegedly infringing material, plus your contact info and a good-faith statement that the use is unauthorized.

11) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee the Service will be uninterrupted, secure, or error-free, or that content will not be lost.

12) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR GOODWILL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED USD $100.

13) Changes to these Terms

We may update these Terms from time to time. We’ll post the updated Terms and change the effective date above. Continuing to use the Service after changes take effect means you accept the updated Terms.

14) Governing law and venue; small claims

These Terms are governed by the laws of the State of Minnesota, excluding conflict-of-law rules. You and we agree to exclusive jurisdiction and venue in state or federal courts located in Minnesota, except either party may bring eligible claims in small claims court.
